9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SKYDDA AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE. SKYDDA'S TOTAL AGGREGATE LIABILITY ARISING FROM YOUR USE OF THE SITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

10. Indemnification

You agree to indemnify, defend, and hold harmless Skydda and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your breach of these Terms; (b) your use of or inability to use the Site; (c) your violation of any applicable law or regulation; or (d) your infringement of any right of any third party.

Skydda may modify these Terms at any time. We will post the revised Terms on the Site and update the "Last Updated" date. For material changes, registered users will be notified via email and required to re-accept the updated Terms prior to continued access. Your continued use of the Site after posting of non-material revisions constitutes acceptance.

Your use of the Site is also governed by Skydda's Privacy Policy, available at skydda.ai/privacy. The Privacy Policy explains how Skydda collects, uses, and protects your personal data and is incorporated into these Terms by reference. By accepting these Terms, you acknowledge that you have read and understood the Privacy Policy.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Site shall be resolved through binding arbitration or, where arbitration is not available, in a court of competent jurisdiction in the State of Washington. Both parties consent to personal jurisdiction in the applicable forum.

14. General Provisions

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Skydda concerning your use of the Site and supersede all prior agreements. If any provision is found unenforceable, the remaining provisions remain in full force. Skydda's failure to enforce any right is not a waiver of that right. You may not assign these Terms without Skydda's prior written consent.
